Court Ruling Denies Challenged by Delaware State Sportsmen's Association

WILMINGTON, Del. – Just yesterday, the U.S. Court of Appeals for the 3rd Circuit ruled against the Delaware State Sportsmen’s Association (DSSA) challenge of two Delaware gun regulation laws. The ruling is a significant victory for gun reform advocates amid the national debate over the Second Amendment.

Details of the Delaware Gun Regulation Challenge

The DSSA, an influential group representing gun owners and enthusiasts, attempted to overturn two gun control legislation in Delaware. Specifically, the DSSA challenged the proposal of raising the firearm purchasing age from 18 to 21, banning high-capacity magazines, and restricting assault weapon access. The association stated that the new laws infringed on their constitutional rights and further surpassed the state’s power.

Despite the District Court denying the challenge in March of 2023, the plaintiffs appealed hoping to have their claims heard. However, the Appeal Court agreed with the lower court’s decision on the case. Judge Stephanos Bibas stated the evidence presented by the DSSA did not show irreparable harm. The courts decided the legislation was not a breach of the constitution but an act to uphold public safety. After the ruling, Delaware will continue to move forward with the gun regulation laws as is. Delaware Attorney General Kathy Jennings praised the decision, emphasizing the importance of gun safety.
