The Kathy McGuiness trail is finally over. The jury in the historic trial of the State of Delaware versus Auditor Kathy McGuiness has declared her guilty on three of five charges.
The verdict was announced Friday, July 1, 2022, at the Kent County Courthouse in Dover.
She was found guilty of conflict of interest, structuring, and official misconduct, and not guilty on felony theft and intimidation.
In a WDEL.com article it states, On Tuesday, Governor John Carney weighed in on the conviction of State Auditor Kathy McGuiness on three misdemeanor charges while in office, stating there’s not much he can do about her maintaining her role, his hands are tied for now.
Her defense attorney Steven Wood announced they’d be appealing the convictions, McGuiness announced not only was she not stepping down, she’d continue her campaign for reelection.
Carney’s statement on July 5, 2022, essentially explained he can do nothing to remove McGuiness from office, regardless of personal belief, until her convictions are upheld by a Superior Court decision.
“The Auditor of Accounts has been found guilty by a jury of three misdemeanors. The Delaware Supreme Court has made it clear that under Article XV, Section 6 of the Delaware Constitution, addressing the removal of ‘any public officer convicted of misbehavior in office or of any infamous crime,’ the Governor has no power to act until after the entry of a judgment of conviction by the Superior Court.
So, we just have to wait on the Superior Court decision to see if Kathy McGuiness will still be an Auditor for the state of Delaware.
